Before House Bill 1325 was signed, hemp and CBD were under Texas laws as controlled substances. This meant, at the time; it was illegal to produce, manufacture, inspect, and retail sell any hemp and CBD-infused products. Now that's not the case, and CBD is legal in Texas, including CBD oil and other parts of the plant, such as hemp flower, stem, and seed.

Testing Regulations 

Another common question: is hemp oil legal in Texas? CBD can be found in both hemp and marijuana, as they both come from the cannabis plant. However, if there is .3% or less of THC (tetrahydrocannabinol), it is considered hemp.

Since THC is the compound associated with marijuana and creates a high, hemp-related products need to be tested and regulated to ensure the THC levels stay at or below .3%. If the hemp-related product passes testing regulations, selling and possessing it in Texas is legal.

However, the plants aren't only tested for the levels of THC. In fact, under Sec. 443.151. of the Texas Health and Safety Code, plant samples must be taken to test the level of cannabinoids. The sample test also checks for levels of pesticides, heavy metals, any amount of harmful microorganisms, and solvents used during processing.

This means that Texas residents can use CBD oil and other food-based CBD products that are produced, tested, sold, and marketed in compliance with the laws outlined.

Since each state has its own laws, it's essential to understand the regulations associated with traveling with CBD or transporting it across state lines. However, in general, you can fly with hemp-derived CBD products due to approval by the TSA.

However, if you are driving or flying into a state or country that has yet to legalize CBD, you could be putting yourself at risk. With that said, double-check the laws before arriving in another state or country to avoid any legal issues.

Remember that CBD products containing more than .3% THC are considered marijuana, which is a controlled substance. So with that, be sure you are purchasing your CBD from reputable online or brick and mortar stores.

According to Sec. 443.204. of the Texas Health and Safety Code, the only hemp-derived product that is illegal to sell or use in Texas is products that are intended for smoking.

All CBD products except ones intended for smoking are legal to sell and use in Texas. However, things weren't always this way. Before the 2108 Farm Bill was signed, Texas had strict regulations on all hemp-related products, even if they had low THC levels.

In fact, hemp and hemp seeds were on the Drug Enforcement Administration's (DEA) controlled substance list. Once the Farm Bill was signed, the DEA took them off, meaning that topicals, edibles, and CBD oils are now considered legal in Texas.

From there, each state voted on whether or not to legalize hemp, CBD, and marijuana within their state. Some states didn't allow the use of hemp products at any level, while others embraced the green light.

For Texas, House Bill 1325 was created to establish clear laws concerning how hemp products would be produced, manufactured, and sold. Then in June of 2019, CBD in Texas was legal, but it still needed to pass testing regulations and be under .3% THC levels.

Moving forward, the Texas Department of Agriculture works with the Department of State and Health Services to revise the hemp regulations and laws as needed.
